At least this sad statistic isn't true in every one of the 50 largest cities but it's relective of a big problem in America:
Seventeen of the nation's 50 largest cities had high school graduation rates lower than 50 percent, with the lowest graduation rates reported in Detroit, Indianapolis and Cleveland, according to a report released Tuesday.
Those sobering statistics were compiled in a report released today by the America’s Promise Alliance, which intends to draw attention to poor graduation rates, especially in urban areas.
Nationally, about 70 percent of U.S. students graduate on time with a regular diploma and about 1.2 million students drop out annually.
"When more than 1 million students a year drop out of high school, it's more than a problem, it's a catastrophe," said former Secretary of State Colin Powell, founding chair of the alliance.
His wife, Alma Powell, the chair of the alliance, said students need to graduate with skills that will help them in higher education and beyond. "We must invest in the whole child, and that means finding solutions that involve the family, the school and the community." The Powell's organization was beginning a national campaign to cut high school dropout rates.
The group, joining Education Secretary Margaret Spellings at a Tuesday news conference, was announcing plans to hold summits in every state during the next two years on ways to better prepare students for college and the work force.
The report found troubling data on the prospects of urban public high school students getting to college. In Detroit's public schools, 24.9 percent of the students graduated from high school, while 30.5 percent graduated in Indianapolis Public Schools and 34.1 percent received diplomas in the Cleveland Municipal City School District.

Naturally, as part of the deal Merck admits no fault in two cases involving Zocor. Mevacor, Vioxx and Pepcid. No surprise here, right?
A sales manager, H. Dean Steinke, who "just couldn't abide" by the way Merck wanted him to market the drugs Vioxx and Zocor to doctors took the lonely step of filing a whistleblower suit against his employer. He will now be rewarded to the tune of $68 million for his honesty, reports the AP.
Merck & Co. will pay $671 million to settle claims it overcharged government health programs for four popular drugs and gave doctors fees and gifts to induce them to prescribe its drugs, U.S. prosecutors and company officials said today.
The alleged overcharges, dating back to the mid-1990s, involved Medicaid programs in all but one state and the District of Colombia, as well as federal health-insurance programs at agencies including the Public Health Service, Department of Defense, and Veterans Administration.
A nationwide investigation by federal prosecutors, triggered partly by a former Merck salesman-turned-whistleblower and a Louisiana doctor who exposed part of the alleged overcharging, resulted in two settlements announced today.
In Philadelphia, U.S. prosecutors said Merck agreed to pay $399 million plus interest for improper calculation of Medicaid rebates and its marketing practices. And in New Orleans, the U.S. Attorney's office said the drugmaker agreed to pay $250 million plus interest for its rebate practices.
The interest payments boost the total payout to $671 million, Merck said.
"What we have here is a disagreement (over) the rules of the Medicaid rebate program," a Merck spokesman, Ronald Rogers, said. "These civil settlements were the best and most appropriate way to resolve these lengthy investigations and bring these matters to closure."
...Prosecutors said Merck, however, was hiding the steep discounts it gave to hospitals that used a set amount of Merck products and was reporting higher prices to the government.
Between 1997 and 2001, prosecutors said Merck also gave money and perks to doctors and other health care professionals to entice them to prescribe Merck drugs, a practice the government called excessive.
The Philadelphia case involved pricing programs for the cholesterol drugs Zocor and Mevacor and the painkiller Vioxx, which Merck pulled from the market September 2004 because Vioxx doubled risk of heart attack and stroke. Those programs ran from 1996 through 2006, a Merck spokesman, Ron Rogers, said.
The Louisiana case involved pricing for the heartburn drug Pepcid, from mid-1996 to April 2001, when it was still sold as a prescription drug. Source
And in another report, "Merck believes its pricing and sales and marketing policies and practices were consistent with all applicable regulations and contracts during the relevant time," the company said.
Viveca Parker, an assistant U.S. attorney for Eastern Pennsylvania, said that between 1998 and 2006 Merck agreed with "hundreds" of hospitals nationwide to provide them with Zocor and Vioxx for about 10 percent of the market price, in return for their agreeing to buy higher volumes.
"That price was not being offered to the government," Parker said.
Also, between 1997 and 2001, Merck promoted its drugs by providing doctors all-expense paid trips and free dinners. The company also paid doctors to allow sales representatives to accompany them on their rounds, she said.

Detroit, Michigan: A restaurant owner in Virginia, Talal Chahine, had been investigated for possible ties and funding to Hezbollah. As a result, he was indicted but he fled the country in 2005 to Lebanon.
Meanwhile, his sister-in-law, Nada Nadim Prouty, who had earlier obtained her U.S. citizenship illegally by marriage, was working for the FBI and CIA! She apparently retrieved sensitive information from the FBI regarding what federal investigators knew about her, La Shish restaurant owner Talal Chahine, and her sister, who is married to Chahine.
Normally the government would deported a person who obtained their citizenship illegally but not in this case:
"...Prosecutors said she took an unknown quantity of classified information home with her. It’s unclear what happened, or what she did with the information, prosecutors said.
The information pertained to a federal investigation of Chahine and his possible involvement with Hizballah, which has been declared a terrorist organization by the U.S State Department.
In 2002, Chahine and his wife, Elfat El Aouar, attended a fundraising event in Lebanon, where the keynote speakers were Hizballah leaders.
Under the terms of a plea deal with the U.S. Attorney’s Office, Prouty would face a prison sentence of 6-12 months, be stripped of her U.S. citizenship and be ordered deported. Prouty hired an unemployed U.S. citizen to marry her in 1990, a year after she entered the country and overstayed her student visa.
However, prosecutors said she won’t be allowed to leave the U.S. because she used to work for the FBI and CIA and has access to sensitive information vital to homeland security.

In Syracuse, New York a hearing was held Wednesday about his ill-conceived driver license plan for illegal foreign nationals. Several Court Clerks have said they will refuse to issue driver licenses to illegals.
..."A total of 31 county clerks have gone on record against the proposal. Giving clerks the platform at the hearings is Assembly republican leader James Tedisco, who's already threatened to sue the governor over the license plan.
“Drivers licenses are a first line of universal identity. It’s the way we get into all our areas of security. We can't give that up,” said minority leader Tedisco.
Immigration lawyer Sharon Ames offered the only support for the Spitzer plan at the public hearing. "It's not going to give them any legal status. It's not going to change Homeland Security's position of deporting them if they're here illegally. What it's going to do is provide a database so that the government can locate people, track people."
Tedisco's tough line has apparently touched off a fight with Spitzer. In a front page exclusive, headlined "Road Rage," the New York Post reports the governor is pulling $300,000 in health care funding for Tedisco's assembly district."
The Washington Times quoted Governor Spitzer as saying:
"The rabid right that wants to pile on and use this to demagogue the issue will not carry the day in New York state."
DMV Commissioner David J. Swarts defended the plan Monday as a way to get hundreds of thousands of illegal immigrants already in New York into the state data base. Spitzer said that will make the streets safer for drivers, reduce auto insurance rates, and provide a better tool for law enforcement and homeland security to track illegal immigrants. He noted several homeland security and law enforcement experts support it.
"Fear is a major element in the misrepresentation of this issue," Swarts told senators. He described Republicans' criticism as "hysterical rhetoric" that was "deliberately misstated."
Something this important should have been completed by the legislature. The way the Governor and his people are mud-slinging inflammatory words back at the people who are opposed to his order is quite worrisome and show a total lack of leadership. Sounds like Spitzer is full of himself. His plan may be more about getting a certain percentage of those illegals to mark on their application that they are a citizen so they can register to vote. His actions will dilute the worth of citizens. Totally shameful.
An FDA panel has voted to ban children's cold medicines because there is no evidence they are effective! My God, do you see the type of greed we are talking about here?
"Pediatric cough and cold medicines were approved in the early 1970s despite almost no evidence that they worked because regulators generally assumed that drugs that worked in adults would also be helpful in children. Since then, dozens of drugs first tested only in adults have been found to be entirely ineffective or improperly dosed for children.
Whether drug makers will follow through on the panel’s recommendations to undertake large studies is far from clear. Nearly all of the medicines commonly used in over-the-counter remedies long ago lost patent protection, so any money that manufacturers spent on studying these drugs would also benefit competitors who spent nothing.
The panel’s vote is a reminder that many drugs Americans commonly use have never been examined closely and may not work. Standards for clinical trials have changed dramatically over the last 30 years, but thousands of drugs presently sold were approved under older, less stringent standards."
I wish I could say these raids took place somewhere south of the border but, I can't. The largest cockfighting raids in U.S. history took place this past weekend near San Diego, California. It involved over 5,000 birds! When you think about it, doesn't this provide, yet another, piece to a larger puzzle about the general degradation imposed upon our society as the result of our sovereign land being invaded and overtaken in some areas by the illegal activities of illegals? In this case it was Filipinos bringing in their 3rd world pastime of birds killing birds. These were not not Filipinos Americans, mind you, but Filipinos. This does not speak well, once again, for California and the illegal foreign national problems they have created for themselves.
"State and federal authorities described a weekend cockfighting raid as the biggest in U.S. history after agents found more than 4,400 birds being raised and trained to kill at the same compound where they carried out what was then the largest bust six years ago.
The operation was managed and patronized largely by Filipinos, and fights were staged in the San Diego area, officials told KNSD. But the operation also sent many of its birds to the Philippines, authorities said.
Cockfighting is legal in the Philippines, where it is called “sabong” and is considered to be a national pastime. Crowds gather in large arenas seven days a week to wager on their favorite birds.
Hundreds more birds were found at a second training ground nearby in Nestor, near the Otay Mesa industrial area of San Diego, officials told NBC affiliate KNSD-TV. They said more than 5,000 birds were discovered at the two locations altogether."
One of the raids took place at the site of what had been the largest cockfighting raid in the nation’s history back in 2001.
A so-called Christian group who is working for the "Latino Community" in our country believes it can tell our state what to do. Today they filed a lawsuit to stop our new anti-illegal foreign national law, HB 1804.

Those leaders had strong words for the people behind the immigration law and the Tulsa County Sheriff's Office.
"The sheriff of Tulsa County is guilty of ethnic cleansing and I can tell you very clear, that we will continue pursuing to find the reasons why these people have committed these atrocities against our Latino community,” said Rev. Miguel Rivera with the National Coalition of Latino Clergy."
Their allegations are a tactic designed to shift the blame of the illegal actions of others onto the backs of the citizens of our fine state. To think Oklahoma citizens, our legislature and law enforcement officers are being attacked by an outside group called the National Coalition of Latino Clergy is stunning. The President of this coalition is Rev. Miguel Rivera, and get this, he serves on the White House's Council for Immigration Reform!

I believe there are Muslims in some of our neighborhoods that have a Muslim Brotherhood agenda. The Muslim Brotherhood is a world-wide Islamic organization working to create a global Islamic state. That would mean they want to destroy our democracy. These people will likely hide their agenda and try to gain our trust and some will even try to get elected to various offices within our communities. It takes a keen eye and research to undercover what is going on right under our noses. One example happened in Ohio recently and it took an individual who was really paying attention to figure it out. More has been written about them here.

And what does this incident tell us about the domestic terror threat and the process of radicalization happening right now in the US?
The key was her name. When the Columbus Dispatch identified the candidates who had applied for this school board position on December 5, 2006, and when those who were being interviewed were publicly announced, this innocuous entry appeared

The reason a Hamas operative almost ended up on the school board of the 15th largest school district in the country was that she has been using two separate identities: her Muslim convert name, Anisa Abd El Fattah (“Anisa, servant of the conquest”), when she was publicly defending the terrorist organization Hamas; and her given name, Caroline Keeble, when she was operating in Columbus and circulating amongst the city’s political and cultural elite. As the pictures below clearly show, any uninformed observer would hardly realize that the two individuals were actually the same person.

Thus far, there is no indication that anyone with the Columbus Public Schools or the establishment media was ever aware of anything in Fattah/Keeble’s political activist background. Even though she was not selected by the school board to fill the open seat (she had also applied for a previous board opening) - by maintaining dual identities and doing most of her work promoting Hamas under her Arabic name, she had been able to evade the scrutiny of local counter-terror researchers, myself included.
It was only after a recent letter to the editor she had published in the Columbus Dispatch as Fattah and which declared that all Israelis (men, women and children) in Gaza were combatants and legitimate targets for terror operations, that I became aware of her presence in Central Ohio at all. It was only after several days of research that her second identity was discovered.
So how did I finally establish the connection between her two identities? As I said, the letter to the editor a few weeks ago made me aware that Fattah was living in Columbus. That’s what initiated my research, but it wasn’t much to go on, since it was the first time that Fattah appeared on the radar in the area. Apparently, since her arrival in Columbus after UASR came apart when Ahmed Yousef fled the country, she had been only using her Caroline Keeble name, essentially taking “Fattah” (her convert name) underground. The letter was the first time that I could find her Fattah identity was ever used here publicly."

It has become quite apparent that the richest Americans control a larger and larger percentage of the nation's wealth. It's a figure that most Americans have to be sick about. President Bush says it is because most Americans lack the proper skills. When will Americans say enough, we are done and mean it?
According to new data from the Internal Revenue Service, the wealthiest 1 percent of Americans earned a record-breaking 21.2 percent of all income in 2005, reported today in the Wall Street Journal. Up sharply from 19 percent in 2004, and surpasses the previous high of 20.8 percent set in 2000, at the peak of the previous bull market stocks, the Journal reports.
The bottom 50 percent earned 12.8 percent of all income, down from 13.4 percent in 2004 and a bit less than their 13 percent share in 2000, according to the Journal.
"In an interview yesterday with The Wall Street Journal, President Bush said, "First of all, our society has had income inequality for a long time. Secondly, skills gaps yield income gaps. The IRS data show that the median tax filer's income -- half earn less than the median, half earn more -- fell 2% between 2000 and 2005 when adjusted for inflation, to $30,881. At the same time, the income level for the tax filer just inside the top 1% grew 3%, to $364,657. Wall Street Journal
The IRS data confirms the growing concerns most Americans have for their future earning power and security. A nation that consistently only increases the earnings of its top tier earners is a failed nation.
I heard Department of Homeland Security Secretary, Michael Chertoff, say this today when interviewed on Fox News about a federal judge's ruling against the government's attempt to enforce our immigration laws.
Extending an earlier injunction, U.S. District Judge Charles Breyer in San Francisco criticized a government plan to punish businesses that don't fire workers whose Social Security numbers don't match government records. He said the records have so many errors that, with only a 90-day time frame, the verification process would "result in the termination of employment to lawfully employed workers."
At issue are "no-match" letters from the Social Security Administration, which are sent to large employers when workers' Social Security numbers don't match government records."
So my fellow Americans here is another big win for the illegals who are stealing and using false IDs right and left. If you are wondering, this judge was an appointee of President Clinton which may explain a liberal attitude that makes it against the law to follow the law.
On Monday, former Mexican President leveled very serious charges against the American people. All I can say is how dare someone from another country come into our country trying to promote a book (please don't buy it) and make these claims.
Americans have a right to protect their borders from an invasion of illegal foreign nationals and we have a right to stand up to these charges:

A column in New York Times Magazine recently answered a question from a physician about a patient. The physician wrote a patient he saw in the E.R. did not want to be treated by him because he, the physician, was Muslim. The physician refused to allow the patient to be evaluated by a physician assistant and was discharged without an evaluation. The author, Randy Cohen, responded that perhaps the physician could have handled the situation better but the patient had no right to change physicians because of religion. Cohen agreed with the doctor not to allow the PA to exam the patient.
There's a potential problem with Cohen's answer. This physician is likely a member of the Islamic Medical Association of North America (IMANA) whose mission is to promote a greater awareness of Islamic medical ethics and values among Muslims and the community at large.
This Islamic organization says nothing about American medical ethics. Their vision is to become the recognized leader in national and global healthcare, guided by Islamic values! Their first objective is to promote a better understanding, appreciation and propagation of Islam! The propagation of Islam?

Islam considers access to health care as a fundamental right of the individual---In addition, a Muslim physician derives his /her conclusion from rules of Islamic laws (Shari`ah) and Islamic medical ethics. On this page, they go into their history and that they are a constituent of the Islamic Society of North America. This national organization was named in June and an unindicted co-conspirator in the Holy Land Foundation Trial for their association with the Muslim Brotherhood!
I sure hope Mr. Cohen becomes more educated about this association and takes their goals and agenda into account before responding next time.
It would be reasonable for Americans to prefer a physician bound by American medical values and ethics and not one who needs to consult an Islamic religious scholar or be dictated by Sharia Law here in AMERICA!
Illegal foreign nationals in our country are a big concern to the average citizen. Their presence and what effect they can have is heightened by a recent study by the University of Connecticut which says in the U.S. states with large populations of illegal immigrants could pick up additional seats in Congress after the 2010 census is conducted!
"The University of Connecticut study concluded Arizona, Texas, and Florida could all see their House delegations increase due to their rising illegal alien populations. Although they are not allowed to vote, illegal aliens are included in the census. Congressman John Carter (R-Texas), a staunch opponent of illegal immigration, says increasing a House delegation because of illegal aliens, although inappropriate, is currently the law of the land.
"We assume that the law in the Constitution of the United States says you count the American citizens, but it doesn't say you count the American citizens, you count the people that are in the state. So that's the loophole they're talking about. These people are illegally in our state -- [and] I'm opposed to them being illegally in our state, or your state or any other state," says Carter.
Carter jokes that he is "never made a head count" of illegal aliens in his district but adds, "there's a ton of 'em." In an October 4th Presidential Bulletin, Rev. Miguel Rivera, President of the National Coalition of Latino Clergy and member of President Bush's White House Immigration Reform Coalition, said that within hours a lawsuit to defeat Oklahoma's anti-illegal foreign national law will be filed. He also said the Mexican American Legal Defense Fund will jointly contribute their legal support. In a translated version of the bulletin, Rivera makes the deeply disturbing claim that ethnic cleansing is taking place in Tulsa.

A KRNV News 4 viewer called into this Reno, NV. TV station yesterday to report a business in Reno was flying the Mexican Flag on top of the American Flag! The station went out and took this picture. Then the TV news crew caught veteran, Jim Broussard, going up to the pole and cutting down the U.S. Flag with an Army knife. He did it in order to honor his country by removing it from the lower position on the flag pole (which is against the law). It is a must watch. Hat's off to Veteran, Jim Broussard!!!

Today, the ACLU is whining this really isn't the law:
The ACLU of Nevada is concerned about recent media reports that it is "illegal" to fly foreign flags over the U.S. flag. While there is indeed a federal law regulating the display of the U.S. flag, that law is merely advisory and simply codifies standard government practice in displaying the American flag. Several federal courts have examined this law and held that the flag rules are not mandatory and cannot be enforced."

The Tulsa World is reporting today that the National Coalition of Latino Clergy has announced plans for a press conference at 12 noon on Friday on the filing of the lawsuit against the State of Oklahoma for daring to create a law, HB 1804, designed to stop the tens of thousands of illegal foreigns nationals who have invaded our state.

House Bill 1804, the Taxpayers and Citizens Protection Act, is due to go into effect Nov. 1. It would make it a felony to transport, conceal or shelter an undocumented immigrant from detection. It also prevents illegal immigrants from getting jobs and public assistance.
The Rev. Miguel Rivera, president of the National Coalition of Latin Clergy and Christian Leaders, is expected to make the announcement at a noon news conference Friday at the Tulsa’s Hispanic Chamber of Commerce, 10802 E. 31st St.
Also at the news conference, the Rev. Victor Orta II, president of the American Dream Coalition, will ask for a moratorium on immigration raids and deportations until Congress agrees on a comprehensive and fair immigration reform, according to a press release."
Update 10/6/07: Despite all the hype and talk, no formal announcement of the actual filing of the lawsuit to defeat HB 1804 could be found.
Update: 9/28/07: A Hispanic leader in Tulsa says his group plans on filing a lawsuit seeking to have House Bill 1804 declared unconstitutional. That announcement should come at a news conference at noon Friday in Tulsa. The Reverend Miguel Rivera is the national president of "CONLAMIC" or the Coalition of Latin Clergy and Christian leaders. Rev. Rivera says at that news conference, he will announce a date for when he plans to file the lawsuit. KOTV
9/28/07: Hispanic leaders promised Friday that the suit could come within days, and would question the constitutionality of House Bill 1804, which goes into effect Nov. 1.

Update 6 PM: The National Coalition of Latino Clergy and Christian Leaders (CONLAMIC), which had initially planned to file a lawsuit hoping to bar implementation of HB 1804 as early as Sept. 27, will instead publicly announce on Sept. 28 that it will await the Attorney General’s opinion on the legal questions raised in the lawmakers’ letter before filing suit.
“We will be calling on the Attorney General to expedite his review of the letter and the issuance of his official opinion,” a spokesperson for CONLAMIC-OK, the group’s Oklahoma chapter, told La Semana del Sur. “Once we have seen the opinion, we will decide if we still need to proceed with the lawsuit.” From lasemanadelsur
Rep. Pete King recently did an interview with Politico where he said there are too many mosques in America. The Democrats National Committee (Islamist sympathizers?) apparently thought what King said was deplorable according to the Council of American Islamic Relations.
Now CAIR is trying to silence him with an Action Alert. They are requesting Republican presidential candidate Rudy Giuliani dump King and commentator Daniel Pipes as campaign advisors because of their extremist and Islamophobic views and comments.

Have you noticed how vocal this group is? My God, aren't Muslims a very tiny part of our society? Then why does it seem they complain so much of the time? Is it just me? What is worrisome is this just the beginning of CAIR's efforts to silence those who speak out about their concerns with Islam?
It's just like CAIR, who has given a speech or two under the Hezbollah flag, who has stated publically that the Koran should be the highest authority in America, who planned and participate in a meeting with HAMAS, who is associated with the Muslim Brotherhood which seeks to destroy our democracy, to get offended because someone stands up bravely about what's going on in our country.

Columbia President, Lee Bollinger issued a statement:

This invitation is a slap in the face to Americans. Iran sponsors terrorists! If this had happened back in the day of Hitler, no doubt Columbia would have invited him to speak.
Interestingly, Columbia just denied a speaking engagement to Jim Gilchrist, founder of the Minuteman Project. On Oct. 4 of last year, Gilchrist’s speech in Roone Arledge Auditorium was halted after student protesters rushed the stage. Humm.
University President Lee Bollinger was asked about the events while appearing on Inside City Hall on local television station NY1.
“Students can invite people for political reasons or whatever reasons they want, but they can also choose not to invite people, and my understanding is that some student groups have decided not to invite somebody to speak, and that’s their right, too,” he said.
Upon hearing about the CPU’s revocation of sponsorship, Gilchrist, speaking to the Associated Press, accused the group of “succumbing to pressure from anti-freedom-of-speech gangsters.”

Efforts to add an amnesty for illegal farmworkers (AgJOBS) to the farm bill (H.R. 2419) have been delayed. However, pro-amnesty advocacy groups have been promised that AgJOBS will be attached to that measure this fall and signed into law.

Real (adjusted for inflation) Median Household Income has been measured since 1967. For that year the figure was $36,847. In 2006 the real median household income in the U. S. was $48,201. So in this 39 year span this amount has increased less than $12,000!!! See page 12 of the new Census Bureau report. I hate to even venture a guess how much the cost of living has increased since 1967. And we wonder why things are not so good for so many.

Congressional representatives are doing significantly better than the average family. Their annual salary was $30,000 in 1967 nearly $7,000 less than the median household income for that year. For 2006 their salaries was $165,200 nearly $120,000 more than the median household income (congressLink). See how out of whack this has gotten? It is shameful. Since their raise is automatic every year Congress can easily say I did not vote for a pay increase. Instead you should ask them if they voted not to take a pay increase. It's obvious our elected representatives have clearly looked out for themselves while ignoring those who elect them. WAKE UP AMERICANS. This makes me so sick.

This is so outrageous to me I can hardly speak for our once awesome country's elected officials has backstabbed its citizens. My fear is Americans are way too complacent largely because we thought all was well for years. This isn't the case. If you find this offensive and a dereliction of Congressional duty to American citizens, the very people Congress is suppose to represent, tell everyone you know. Please start talking and urging everyone you know to call or write Congress. This issue is symbolic to me how totally dysfunctional our Congress has become.
Kansas Illegal Foreign National Tuition Ruling Upheld
"Kansas began offering lower in-state tuition to illegal immigrants in 2004 and a year later a group of college bound U.S. citizen filed a federal lawsuit claiming that the measure violates the 14th Amendment’s equal protection clause because it offers illegal immigrants a benefit they could not get.
The suit asked the federal courts to require that the state either eliminate the tuition benefit for illegal aliens or offer the same rate to all U.S. citizens, even those from other states. But a federal judge in Topeka ruled in 2005 that the plaintiffs lacked standing to bring the legal challenge because they failed to demonstrate that the law had harmed them.
The students naturally appealed and this week a three-judge panel of the Denver-based 10th U.S. Circuit Court of Appeals basically upheld the lower court’s decision. In its 26-page ruling the judges wrote that the students had failed to provide evidence that they had been directly harmed by the Kansas law or that they would benefit if it was reversed.
Federal law requires public elementary and secondary schools to enroll illegal immigrants but it prohibits illegal immigrants from obtaining tuition breaks that are not available to all United States citizens. Regardless, a handful of states—including Texas, California, Utah, Maryland and New York—have passed legislation to grant illegal aliens the perk." Judicial Watch
I guess having to pay two to three times more tuition than the illegal foreign nationals have to pay isn't considered a concrete and imminent injury and ignoring the federal law that prohibits this from happening is irrelevant.
